2. INTRODUCTION TERMS AND CONDITIONS
These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email, or by telephone. By accessing, browsing, and using our (mobile) website or any of our applications and/or by completing a reservation, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below (including the privacy statement).
We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Such changes shall be effective immediately upon posting of the revised terms on this Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.
Please review this Agreement periodically for changes. By accessing or using this Site, you signify your acceptance of this Agreement and agree to be bound by all of its terms and conditions.
3. INCLUSIONS
For each package, Nadived Ayurvedic Clinic and Panchakarma Center’s has outlined your inclusions as a part of your reservation request. Please pay close attention to your package’s inclusions. All of our packages come with stay in a spacious and large suite with its own private treatment area, all meals and yoga and meditation package. All packages except for the yoga and meditation package come with treatments included. For further details on inclusions, please refer to our Tariffs page and the reservation confirmation sent to your email for a final list of inclusions.
4. OPTIONAL EXTRAS
Depending on the package you have picked, optional extras include laundry, local transportation/ excursions, a la carte menu options as well as individual yoga sessions.
5. DEPOSIT POLICY
At the time of your reservation, a booking amount would be requested by Nadived Ayurvedic Clinic and Panchakarma Center to confirm your booking via an online link/ bank transfer within a specific time period. Nadived Ayurvedic Clinic and Panchakarma Center reserves the right to withdraw/ cancel your reservation if the booking amount is not sent within the stipulated time.
Nadived may ask for an additional advance deposit over and above the booking amount during sold out dates, peak season months and for reservations above 4 nights. The purpose of the advance deposit is to guarantee a reservation, and this amount is applied to the guest’s bill upon check in. Also known as a guarantee, these advance deposits help cover costs of last-minute cancellations. When required, Nadived Ayurvedic Clinic and Panchakarma Center team shall write to the guest to ask for such an advance payment.
6. CHECK IN CHECK OUT POLICY
Please refer to your reservation email for Nadived Ayurvedic Clinic and Panchakarma Center’s check in check out policy. By paying a deposit amount to confirm your reservation, you hereby accept Nadived Ayurvedic Clinic and Panchakarma Center’s check in check out policy.
7. CANCELLATION & POSTPONEMENT POLICY
Please refer to your reservation email for Nadived Ayurvedic Clinic and Panchakarma Center’s Cancellation & Postponement Policy at the time of your reservation. By paying a deposit amount to confirm your reservation, you hereby accept Nadived Ayurvedic Clinic and Panchakarma Center’s cancellation and postponement policy.
8. OUTSIDE FOOD/ BEVERAGES
At Nadived Ayurvedic Clinic and Panchakarma Center, all meals are provided for by our chef from Nadived Ayurvedic Clinic and Panchakarma Center’s open concept kitchen. Outside food and beverages are not permitted in order to ensure that your Ayurveda experience continues to focus on healing with the right food.
9. SMOKING & ALCOHOL
Nadived Ayurvedic Clinic and Panchakarma Center has a strict no smoking policy except in Nadived Ayurvedic Clinic and Panchakarma Center’s designated smoking zone. No alcohol is permitted at Nadived Ayurvedic Clinic and Panchakarma Center.
11. PRIVACY AND COOKIES
By completing a trip reservation with Nadived Ayurvedic Clinic and Panchakarma Center and paying the deposit, you agree to receive emails prior, during and post your arrival giving you information on your reservation, on Nadived Ayurvedic Clinic and Panchakarma Center or other promotional content. By providing your information, you also allow Nadived Ayurvedic Clinic and Panchakarma Center team members to contact you via email and phone number in regards to your current or any potential future reservations at a Nadived Ayurvedic Clinic and Panchakarma Center property. In order to duly complete and secure your Trip Reservation, you need to use your correct email address. We are not responsible or liable for (and have no obligation to verify) any wrong or misspelled email address, or inaccurate or wrong (mobile) phone number or credit card number.
12. CLAIMS/ COMPLAINTS
Any claim or complaint against Nadived Ayurvedic Clinic and Panchakarma Center must be promptly submitted, but in any event within 15 days after the scheduled day of consummation of the product or service (e.g. check out date). Any claim or complaint that is submitted after the 15 days period may be rejected, and the claimant will forfeit the right to any (damage or cost) compensation.
Due to the continuous update and adjustments of rates and availability, we strongly suggest to make screenshots when making a reservation to support your position (if needed).
13. DISPUTE RESOLUTION
Informal Resolution – Our goal is to exceed your expectations when you book travel through our Site and/or Services, and if a dispute arises between you and us, we strive to resolve the dispute fairly, quickly, and efficiently. Accordingly, you agree to first give us an opportunity to resolve any dispute, claim, or controversy arising out of or relating to your use of our Site, any booking, this Agreement, our Privacy Policy, our Cookie Policy, or the breach, termination, enforcement, interpretation or validity thereof, or our relationship in connection with the Site or these or previous versions of this Agreement or our Privacy Policy or our Cookie Policy (“Claim”) by contacting us at info@Nadived Ayurvedic Clinic and Panchakarma Center.com before taking any other action. If we are not able to resolve your Claim within sixty (60) calendar days after we receive written notice from you of your Claim, you may seek relief for your Claim through the courts in Trivandrum and nowhere else.
YOUR USE OF THIS SITE AND SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
Nadived Ayurvedic Clinic and Panchakarma Center WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN ANY WAY RELATED TO THIS AGREEMENT OR THE USE OF THE SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSE
